Making a personal injury claim is not as difficult as it seems. Very often, there is no need to go to court. Many claims are settled well in advance of going to court, and a proportion of these settle ‘on the steps of the court’. The expert team at Gary Matthews Solicitors have over 20 years experience in handling claims from minor accidents to more complex cases.
Over 50,000 people per year are injured in accidents. In many of these cases, the injured party is not at fault. If this is the case, they are entitled to claim compensation. The first thing you should do when claiming compensation is seek legal advice. You should always appoint a solicitor, who will represent you and get the best possible outcome.
In some cases, such as road traffic accidents, you will receive an offer from the other party’s insurers. Often this is well below what you could get if you appointed a solicitor to deal with your claim.
Most personal injury cases are NOW initiated by submitting a claim to the Injuries Board / PIAB. There are strict time limits for submitting a claim and if the application is incomplete it will probably be rejected. Furthermore, information provided to the Injuries Board has been relied upon in court proceedings by the Defendants to ground an application to dismiss a person’s case and it is therefore important, that the information you supply to the Injuries Board / PIAB is accurate and up to date.
Compensation is decided on a case-by-case basis – by the Injuries Board and courts. They are bound to take account of published guidelines which lay out the appropriate level of compensation for each type of injury. Before beginning your claim, you may want to gather as much evidence as you can. Things like medical records, payslips (you may be able to claim loss of earnings), photographs, names and addresses of witnesses etc can all prove invaluable in claiming your compensation.
Once you enlist the help of Gary Matthews Solicitors in making your personal injury claim, we will handle the case from then on. We will be able to explain how long your claim should take to settle, please see our Book of Quantum diagram for an indication of the type of awards made by the Personal Injuries Board (Your “claim estimator” page, with its diagram setting out amounts of damages for particular body parts, sufficiently estimates the value of awards).
